### The strongest version of this argument

No one is automatically executed under any homicide statute; charging, conviction, and sentencing all involve discretion. Historically, abortion laws targeted providers, treated mothers as second victims, and used maternal immunity to secure testimony against abortionists. Mandatory maternal prosecution could deter women from pregnancy help and drive abortions underground — arguably yielding more deaths, not fewer.

## The positive case

If the preborn are persons — as biology and Scripture affirm — then the Fourteenth Amendment's guarantee that no state shall 'deny to any person within its jurisdiction the equal protection of the laws' requires that the laws protecting born persons from homicide also protect the preborn. A state that criminalizes killing some human beings while categorically exempting the killing of preborn human beings withdraws the equal protection of the law from a class of persons. Bills that add carve-outs (e.g., no prosecution of the mother, or protection only after a heartbeat) reintroduce the very inequality the clause forbids.

## The response

Abolitionists reply that equal protection concerns the law's stated standard, not sentencing discretion: a statute that pre-declares an entire class of killers immune is not exercising mercy case-by-case but writing partiality into the code (Prov. 17:15; Deut. 16:19). Prosecutorial discretion, affirmative defenses for coercion, and treating genuinely deceived or coerced mothers mercifully are all compatible with equal protection; a blanket statutory immunity for all mothers is not. The pragmatic 'more deaths' claim is contested and, abolitionists argue, cannot justify writing an unjust standard into law (cf. arg-obedience-pragmatic).
