# “Bills that ban abortion at a heartbeat, at pain-capability, or after an ultrasound requirement are worthwhile because they reduce abortions and move the culture.”

**Category:** Legal & political · **Mode:** Defensive · responds to an objection

## The objection

**The claim:**

> "Bills that ban abortion at a heartbeat, at pain-capability, or after an ultrasound requirement are worthwhile because they reduce abortions and move the culture."

_A pro-life incrementalist argument._

### The strongest version of this argument

Such bills have measurably reduced abortions in some states and shifted public sentiment by highlighting fetal development. They pass where total bans cannot, and each one arguably saves real children while normalizing protection.

## The response

Abolitionists argue milestone bills codify injustice by making a child's legal protection contingent on a developmental marker (heartbeat, pain, gestational age) that is morally irrelevant if the child is already a human person from fertilization. A bill that protects the child at 12 weeks but licenses killing at 8 weeks writes partiality into law (Deut. 16:19) and is the kind of 'unjust statute' Isaiah pronounces 'woe' upon (Isa. 10:1-2). Biology gives no basis for the lines: the same human organism exists before and after each milestone. Highlighting fetal development is good; making protection depend on it is the error. They also dispute the empirical premise, noting national abortion totals rose after Roe fell.

## Discussion questions

1. What morally relevant change happens at a heartbeat or pain threshold that justifies protecting the child after but not before?
2. If a bill protects a child at 12 weeks but permits killing at 8, is that impartial justice?
3. Is it possible to celebrate fetal-development facts while refusing to make legal protection depend on them?
